1. Acceptance of Terms
By registering for an account and utilizing the distribution services provided by SEA Music ("we", "us", "our"), you ("Artist", "Label", "User") agree to be bound by these Terms and Conditions. These terms govern your use of the SEA Music platform to deliver audio content to Digital Service Providers (DSPs) such as Spotify, Apple Music, YouTube, and Amazon.
2. Copyright and Intellectual Property
Strict Zero-Tolerance Policy: You represent and warrant that you own or have obtained all necessary rights, licenses, and permissions for the master recordings, compositions, and artwork you upload to SEA Music. You must have explicit, written clearance for any samples, beats, or covers.
Uploading infringing content, uncleared samples, stolen beats, or unauthorized covers will result in the immediate takedown of your releases, a permanent ban from the SEA Music platform, and the forfeiture of any pending royalties to cover legal liabilities.
3. Artificial Streaming and Fraud
SEA Music actively monitors for artificial streaming, bot activity, streaming manipulation, and payola in compliance with the anti-fraud policies of our DSP partners (e.g., Spotify, Apple Music). We strictly prohibit the use of third-party services that guarantee streams, playlist placements, or followers for a fee.
If a DSP flags your content for artificial streaming or abnormal streaming behavior, we reserve the right to: (a) issue a takedown of the flagged releases, (b) withhold your royalties, (c) pass on any DSP-issued financial penalties to your account, and (d) permanently suspend your account.
4. Royalties and Payouts
SEA Music will collect royalties on your behalf from DSPs. Accounting and payouts operate on a delay determined by the DSPs, typically 45 to 60 days following the end of the calendar month in which the streams occurred.
Funds will be credited to your SEA Music dashboard once received from the respective stores. You may request a withdrawal once your account balance reaches the minimum threshold of $50.00 USD. SEA Music is not responsible for any banking or PayPal transaction fees incurred during the withdrawal process.
5. Takedown Policy and DMCA
If we receive a valid DMCA takedown notice or a claim of infringement regarding your content, we will immediately remove the content from all DSPs pending an investigation. You agree to indemnify and hold harmless SEA Music from any claims, damages, or liabilities arising out of your breach of these Terms or your upload of infringing material.
You may also issue a voluntary takedown request for your own content via your dashboard. Voluntary takedowns may take 3-7 business days to process across all global stores.
6. Metadata Accuracy and Compliance
You are strictly responsible for providing accurate and compliant metadata (including artist names, track titles, ISRC codes, and contributor roles) for all uploaded content. All tracks must correctly flag "Explicit" or "Clean" content. The use of marketing terms (e.g., "Official", "Exclusive") in titles is prohibited. Furthermore, you must fully disclose the use of Artificial Intelligence (AI) in your compositions or recordings when required by the platform. Inaccurate or misleading metadata may result in delivery rejections, content takedowns, or account suspension.
